The Protecting Opportunities and Workers’ Rights Act (POWR Act), which went into effect on August 7, 2023, fundamentally alters the law against workplace harassment by eliminating the “severe or pervasive” standard for proof of harassment. Join us as Chuck Passaglia from Employment Law Solutions explains this new Colorado law that lowers the bar for bringing viable harassment claims against employers and compels employers to establish a program “reasonably designed” to prevent harassment, deter future harassers, and protect employees from harassment, requiring employers to keep records of all employee complaints of discriminatory or unfair employment practices, whether written or oral, including the identity of the alleged perpetrator, for five years; prohibiting "marital status" discrimination; and placing strict limits on non-disclosure agreements. This brief program highlights the POWR Act's sweeping new requirements for Colorado employers.
